Brief facts of the Reference (Reference No. 16. of 2014) are that, the applicant worked in a position of a journalist with the Central Broadcasting Service LTD (CBS) in Uganda. He was charged, tried and later convicted of criminal defamation by the Republic of Uganda in the Chief Magistrate’s Court of Masaka Holden at Kalangala pursuant to sections 179 and 180 of the Uganda Penal Code (Cap 120 of the Laws of Uganda). On 17th October 2014 he was sentenced to a fine of 500,000/- Uganda shillings and compensation of 500,000/- Uganda shillings or in default to one-year imprisonment.

The applicant therefore filed a Reference in the East African Court of Justice to challenge among others, the laws on criminal defamation in Uganda. The applicant later on died, but the Court case continued with the representative.
